Product Liability

O'Connor v. Nature Food Centers - Suffolk County Superior Court (MA) No. 91-4379. Lead counsel in defense of a claim that plaintiff ingested l-tryptophan resulting in her muscle disorder. After lengthy discovery, plantiff's claim was dismissed by Summary Judgment.

Cluett v. Iowa Mold Tool - Essex County Superior Court (MA) No. 92-892. Lead counsel in defense of claim brought against crane manufacturer for defective hook and latch assembly resulting in compound fracture of plantiff's wrist. Successfully had claim dismissed by Summary Judgment.

DeYoung v. Circuit City - Erie County Supreme Court (NY) No. 05- 4400. Obtained a $689,000 jury verdict for 70 year old plaintiff in a trip and fall.



Wrongful Death

Gradus v. Siemens - Norfolk County Superior Court (MA) No. 92-1598. Decedent's estate alleged defective hearing aid caused plaintiff to be struck and killed by motor vehicle. Obtained Summary Judgment on defect theory and judgment entered for defendant.



Premises Liability

Cheschi v. Boston Edison - Suffolk County Court (MA) No. 76992. Co-trial counsel in which defense verdict was entered against plaintiff and award of attorneys' fees and cost to our client against third party defendant on indemnity claim. Plaintiff fell inside nuclear power reactor while performing system maintenance. Alleged back injury and exposure to radiation.

Marchand v. Purity Supreme - Suffolk County Superior Court (MA) No. 90-2555. Trial counsel in defense of negligence claim in which plaintiff slipped and fell, injuring back, neck and fracturing elbow. Defense Verdict.



Construction Liability

Noble v. Indall Wall Systems - Middlesex County Superior Court (MA) No. 90-6339. Lead counsel in defense of negligence claim for dangerous construction site resulting in fall down stairs. Negotiated favorable settlement with multiple party involvement.



Motor Vehicle

Frazier v. Minicucci - Essex County Superior Court (MA) No. 93-1615. Trial counsel in defense of tort claim in which plaintiff bicyclist was struck by defendant vehicle sustaining multiple injuries including permanent wrist fusion. Defense verdict.

Alberts v. PV Holding Corp. et al. - Monroe County Supreme Court (NY) No. 06-11019; appeal transfered sua sponte by New York Court of Appeals to the Appellate Division, 4th Department (2008 NY LEXIS 1082).  Obtained dismissal of vicarious liability claims against rental car company based on federal statute that pre-empted state vicarious liability statute.  The Court upheld the constitutionality of the federal statute.
